Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and The Moon Is A Harsh Mistress LLC ("Company," "we," "our," or "us") concerning your access to and use of our website (moonmistress.net), mobile applications, and related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, you may not access or use the Services.

Eligibility

You must be at least 18 years old to use our Services. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

Services Description

We provide mobile application development services, including:

iOS application development (Swift, SwiftUI)
Android application development (Kotlin, Jetpack Compose)
Cross-platform development (React Native, Flutter)
Mobile application consulting and strategy
App maintenance and support services

The specific scope, deliverables, timeline, and pricing for any project will be outlined in a separate agreement or statement of work.

Intellectual Property Rights

Our Content: The Services and their entire contents, features, and functionality are owned by the Company, its licensors, or other providers and are protected by intellectual property laws.

Client Work Product: Unless otherwise specified in a separate written agreement, upon full payment for development services, the client shall own the intellectual property rights to the custom application code developed specifically for their project. The Company retains the right to use general knowledge and pre-existing tools or code used in development.

User Responsibilities

When using our Services or engaging us for development work, you agree to:

Provide accurate and complete information
Maintain the confidentiality of any account credentials
Not use our Services for any unlawful purpose
Cooperate and provide timely feedback during projects
Comply with all applicable laws and regulations

Payment Terms

Payment terms for development services will be specified in the applicable project agreement. Unless otherwise agreed, invoices are due within 30 days of issuance. Late payments may be subject to interest charges. All fees are non-refundable unless otherwise specified.

Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim or one hundred dollars ($100), whichever is greater.

Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions. Any legal action shall be brought exclusively in the courts located in Lake County, Illinois.

Changes to Terms

We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to new terms taking effect. By continuing to use our Services after revisions become effective, you agree to be bound by the revised terms.
